During the meeting, we provided a recap of our first town hall, reviewed decades of DEP and OSHA violations, discussed the excavation of the 48 buried drums containing cancer-causing chemicals, and covered many other important developments in our investigation.
One of the most heartbreaking updates is that this investigation continues to grow. At our first town hall one year ago, we had documented 366 victims. Today, that number has grown to 418 victims. Behind every number is a person, a family, and a life forever changed.
Toczydlowski Law Office also shared significant updates on the legal investigation. He discussed his collaboration with a nationally recognized toxic tort law firm, a toxicologist, an industrial hygienist, and an epidemiologist who are all working together to build this case. Most importantly, he announced that he hopes to file with the courts by the end of this year.
While we know there is still a long road ahead, this announcement gives hope to hundreds of families who have waited years, even decades, for answers and accountability.

We had the opportunity to meet with Congressman Rob Bresnahan’s staff, and we are truly grateful for their time and willingness to hear us out.
We laid out everything: the buried toxic drums at the Fern Hill warehouse, its dangerous proximity to Acorn Hill Estates, the long list of DEP and OSHA violations, and the conflicting letter from the Department of Health and Human Services (DHHS) that seems to ignore those serious issues. We also made it clear that despite more than 200 confirmed cancer cases among former workers, not a single government agency has stepped in to help us except for the PA Dept of Health (PA DOH - Different from DHHS), who has offered to do a geographical study of cancer rates in the area.
We brought up the ongoing silence from the Borough of Olyphant, even after multiple attempts to reach out to Borough Manager CJ Mustachio, and the concerning response from the Pennsylvania State Police, who claim they have no records at all tied to a facility that operated for more than 40 years.
We told them our goals:
- We want this officially recognized by the Commonwealth as a disaster, so that victims and families can finally access medical or burial assistance.
- And we want a memorial statue placed at or near the site, so what happened here is never forgotten.
Their team listened respectfully, took notes, and assured us they would personally brief Congressman Bresnahan on all we shared. While we don’t yet know what will come next, we’re hopeful this is a step forward, and we sincerely thank them for hearing our voices.
We’ll continue fighting for accountability, support, and recognition, because these lives matter, and this story deserves to be told. We’re not giving up. We’ll keep knocking on doors and telling the truth until someone finally answers.

"Thank you for checking back. Our office has been in communication with the PA Department of Health (PA DOH) regarding the site and information you shared. We have additional discussions scheduled and will be back in touch following."
Oct 2, 2025 - L.C.O.P. heard back from Congressman Bresnahan's Office again:
"We will circle back following that upcoming meeting with PA DOH. If there is anything in addition to material you previously provided, please let us know and we can make sure to get to them as well."
Nov 17, 2025 - L.C.O.P. sent Congressman Bresnahan a follow-up email saying:
"We understand these matters take time, but even a brief update on whether the scheduled discussions have taken place, and whether any next steps have been identified would mean a great deal to the community.
Our group continues to gather documentation and firsthand accounts, and we remain committed to working collaboratively with your office. We deeply appreciate your engagement so far and respectfully ask if you could share any developments since your last message. Thank you again for your attention to this matter and for your continued efforts on behalf of the residents and families impacted."
Mar 6, 2026 - L.C.O.P. heard back from Congressman Bresnahan's Office:
"We continue to actively engage with Commonwealth officials on the former Specialty Records/WEA Manufacturing/Cinram/Technicolor facility. PA DOH, the lead agency in this matter, recently requested to reschedule a meeting with our office. Following that meeting, we will relay any feedback they provide. Further, if there is any additional information our office could relay to PA DOH on your behalf, please let us know."
Mar 6, 2026 - L.C.O.P. sent Congressman Bresnahan a response saying:
"Thank you for the update and for continuing to engage with Commonwealth officials regarding the former Specialty Records / WEA Manufacturing / Cinram / Technicolor facility. I appreciate your office’s continued attention to this matter and the willingness to relay information between agencies.
If possible, I do have three questions that your office may consider raising during your upcoming meeting with the PA DOH. Please feel free to phrase or present them in whatever manner you believe is most appropriate.
Apr 29, 2026 - L.C.O.P. heard back from Congressman Bresnahan's Office:
"Our office recently met with the Pennsylvania Department of Health to discuss the concerns you raised, which we had previously shared for their review. The Department indicated that it initiated a study based on the information you provided and referenced the attached document, which they stated has already been shared with you.
We understand the importance of this matter and appreciate you bringing it to our attention. Please let us know if you have any additional information you would like us to share with the Department."

Bresnahan's office did not provide any new information or action regarding this matter. The document they provided from the Pennsylvania Department of Health had already been emailed directly to me by the Department approximately two weeks earlier.
More importantly, my additional questions were not addressed at all.
Specifically, I requested information and clarification regarding:
These are significant discrepancies that deserve direct answers, not simply a re-transmission of an existing Department of Health letter.

We contacted the PA Department of Health (PA DOH) requesting that they conduct a comprehensive review of cancer rates in the Olyphant area. Specifically, we asked the Department to compare local cancer incidence with surrounding communities and evaluate whether the types of cancers being reported by former employees were consistent with exposure to the hazardous chemicals known to have been used at the facility.
Nearly a year and a half later on April 10,2026, the Department finally responded, you can see the report on our Health Reports page.
After they reviewed DEP, OSHA, and the Pennsylvania Cancer Registry records... the PA DOH concluded that they could not perform a workplace cancer risk assessment because the facility has been closed for years and historical employee exposure data, air monitoring records, and other critical occupational information are unavailable. The Department also stated that although OSHA inspection information was available online, it was "not helpful" in assessing potential workplace exposures because no chemical sampling results were reported, and they further noted that neither OSHA nor DEP records contained information regarding the personal protective equipment (PPE) used by employees or other measures taken to reduce chemical exposures. So, instead, PA DOH conducted a population-level analysis comparing cancer rates in Olyphant, Blakely, Dickson City, Jessup, and Throop to the rest of Lackawanna County and surrounding counties. They reported that this analysis did not identify a consistent increase in cancer rates across the surrounding communities. Rather than providing a toxicological evaluation comparing the cancers reported by former employees to the chemicals documented at the site, the Department referred us to publicly available Agency for Toxic Substances and Disease Registry (ATSDR) fact sheets for those chemicals.
They essentially said, "We cannot determine whether workers were harmed because we don't have enough historical exposure information, but we also didn't find a statistically significant increase in cancer in the surrounding communities."
The report did not identify new environmental findings, did not analyze individual employee exposures, did not investigate workplace chemical use, and did not answer many of the specific questions we had raised.
